Terms of Service

Eligibility

You must be at least 18 years old to use Staysette. You must have a real, active Instagram account that you own and manage yourself. Accounts operated by agencies on behalf of an undisclosed third party are not eligible without prior written approval from Staysette. By signing up, you represent that both conditions are true.

Acceptable use

You agree to use Staysette only for its intended purpose: connecting your genuine hotel recommendations with your real audience. You may not:

• Use bots, click farms, or automated tools to generate fake bookings or inflate metrics.
• Misrepresent your relationship with any hotel or post fake reviews.
• Recommend hotels you have not personally stayed at, without disclosing that clearly on your page.
• Violate Instagram's Platform Policy, Terms of Use, or any applicable law.
• Use Staysette in a way that could harm other creators, travelers, or hotel partners.

Staysette reserves the right to suspend or terminate accounts that violate these rules, with or without prior notice, at our discretion.

Affiliate earnings disclaimer

Staysette does not guarantee any minimum earnings. Past creator earnings are not predictions of yours. Many creators earn $0. Commissions depend entirely on real hotel bookings that (a) complete checkout, (b) result in an actual stay, and (c) are not cancelled or refunded within the hotel's cancellation window. Pending earnings shown in your dashboard are estimates and may change as bookings settle.

Bookings move from pending to held shortly after the guest's scheduled checkout, and from held to available after our processor confirms the commission has cleared and is no longer subject to clawback by the hotel or supplier — typically a few business days after checkout, but the exact timing depends on our processor. Refunds and chargebacks at any stage will void the corresponding commission. Staysette has no control over whether a traveler cancels or a hotel disputes a booking.

Our fees and payout timing

Staysette takes a platform fee from each confirmed commission. The current fee rate is displayed in your dashboard under Payouts. We reserve the right to update fee rates with 30 days' notice.

Once an earning is in the available bucket, we pay it out via Stripe Connect to the bank account you connect. Payouts require a completed Stripe Connect onboarding. Processing times depend on Stripe and your bank; typically 2–5 business days after the transfer is initiated.

Intellectual property

You own your Reels, photos, quotes, and all content you post on Instagram. Staysette does not claim ownership over your creative work. By using the service, you grant Staysette a limited license to display your Instagram username and the publicly available hotel recommendations you surface on your Staysette creator page, solely to operate the service.

Staysette's own brand, platform design, and software are owned by Staysette and may not be copied or redistributed.

Termination

You can close your account at any time — see Data deletion & requests. Staysette may terminate or suspend your account for violations of these Terms, extended inactivity, or at our sole discretion. Upon termination, confirmed pending earnings already past the hold window will be paid out. Earnings still within the hold window may be forfeited if the account was terminated for Terms violations.

Disclaimer of warranties

Staysette is provided “as is” and “as available.” We make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted service. We do not guarantee that the platform will be error-free, secure, or available at any particular time.

Limitation of liability

To the maximum extent permitted by law, Staysette is not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform — including lost earnings, lost bookings, or Instagram account issues. Our total liability to you for any claim is limited to the fees you paid us in the three months prior to the claim.

Governing law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law rules. Before pursuing legal action, you and Staysette agree to first email contact@staysette.com and attempt to resolve the dispute in good faith.

Changes to these terms

We may update these Terms from time to time. When we do, we'll update the date at the top of this page and, for material changes, email creators at least 14 days in advance. Continued use of Staysette after the effective date constitutes acceptance.
